These general terms and conditions govern all use of katheleys.com and in particular the product offers and sales on this website.When you visit this website or buy a product on it, you agree to be bound by these terms and conditions.

  1. MEMBERS

All Members agree to supply precise information with regard to their identity, address and other data required to access katheleys.com and to update any modifications to this information. To benefit from access to the katheleys.com, all Members must be over the age of 18 and have a valid delivery address.

  1. ORDERS

A binding sale between you as consumer and katheleys.com as seller, governed by these terms and conditions, is concluded when you place an order on this website.Your order shall be deemed placed when you complete the final step of the order process by clicking on “submit order”. By submitting an order, you agree & accept terms and conditions, including all policies such as the Privacy Policy and return sections.   If happens that a product that you ordered is not available, we will inform you .

  1. DELIVERY

All the deliveries are managed by Katheley’s and done by Fedex Express (15€), free shipping over 300€. The delivery takes between 2-15 opening days.

Import Restriction, Taxes and Delivery Duties : The buyer is responsible for payment of import duties and taxes of any kind levied in his country of residence. The purchaser must obtain all relevant tax and customs information in advance from a local tax office. No returns  are accepted if the reason given is a refusal to pay local taxes and customs import duties.

  1. PAYMENT

Payment for items must be received not later than 7 days after the purchase order.The payment can be done by wire transfers or online using the international Paypal platform.
We usually don’t accept Layaway. Exceptionally if a Layaway plan is accepted, we won’t accept any refund of deposit if the Layaway plan is not respected or if the customer finally changes his mind.

  1. RETURN POLICY

Respecting the consumer Law (LPCM of 6 April 2010), the buyer has 14 days to return it.   1. OBLIGATIONS OF KATHELEYS

KATHELEY’S is committed to availing Members of a professional & highly secure online platform and guaranteeing the authenticity of products.   In the event of non-adherence by a Member to these General Terms and Conditions, KATHELEY’S reserves the right to suspend the account of the Member concerned and/or to block the amounts involved up to settlement of the disagreement. KATHELEY’S is committed to protecting personal confidential data concerning  Members.

  1.  OBLIGATIONS OF MEMBERS

By registering with KATHELEY’S, the Member receives a unique ID and a strictly personal code, which he/she must keep confidential. The registered Member only is authorised to use the KATHELEY’S Platform by means of the ID and the personal access code. The Member undertakes not to give any other person access to their ID or pseudonym for the KATHELEY’S Platform. In the event that another person gains knowledge of this and accesses it, the Member will inform KATHELEY’s immediately.– For any first purchase, KATHELEY’S might proceed to validate the identity of the Buyer with the aim of uncovering any fraud. In the absence of the information required by KATHELEY’S being supplied, and in the context of validation of identity, KATHELEY’S may cancel the transaction effected by the Buyer.- The Buyer undertakes to respect all laws and regulation relating to the acquisition of goods of any kind and to acquire the goods exclusively for his/her personal use.- The Buyer undertakes to supply their telephone numbers in order to ensure that the delivery is successful. He/she must ensure that they, or a delegated person, are present to accept the delivery. – The Buyer’s silence on receipt of the Product will confirm that it conforms to the order. If this conformity is contested, the Buyer must directly inform KATHELEY’S. 

  1.  RESPONSIBILITY

Except for gross negligence or intentional negligence on their part, KATHELEY’S may not be held responsible for any damages which may be experienced by a Member, particularly: Loss of operations or information. KATHELEY’S may not be held responsible for any malfunction, breakdown, delay or interruption to access to the Internet network.In any event, the responsibility of KATHELEY’S will be financially limited to the equivalent of the selling price. 

  1. GENERAL PROVISIONS

KATHELEY’S has the power to modify these General Terms and Conditions with regard to the development of its range on the market. Occasionally KATHELEY’S may change the code, telephone number, carry out a de-numbering, interrupt service for operational or maintenance reasons or in the event of an emergency or force majeure.The Member will connect to the KATHELEYS Platform by means of his/her own terminal and telecommunication equipment. KATHELEY’S does not make any materials, telephone installations, terminal equipment, software, etc. available to the Member.Personal data relating to Members are collected, registered and stored in accordance with the provisions of the law of 8 December 1992 with regard to the handling of data of a personal nature on the Internet, such as modified by the law of 11 December 1998, commuting directive 95/46/EC of 24 October 1995 of the European Parliament. Members have access and rectification rights as set out by the law with regard to responsibility for the KATHELEY’S platform.Invalidation of one or more clauses of the General Terms and Conditions of use will not lead to cancellation of these.

  1.  CONTENT AND INTELLECTUAL PROPERTY RIGHTS

Title, ownership rights, and intellectual property rights in the Content whether provided by us or by any other Content provider shall remain the sole property of us and / or the other Content provider.  We will strongly protect its rights in all countries.You may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part, except as is expressly permitted in this agreement.You may download or copy the Content only for your own personal use, provided that you maintain all copyright and other notices contained in such Content. The Member is also informed that his/her authorisation will be requested when transmitting the said data to partner members of KATHELEY’S. In any event, in the context of adherence to the law of 8 December 1992 relating to the handling of data of a personal nature on the Internet, the KATHELEY’S Member has rights of access, rectification and opposition to the data concerning him/her directly on the Internet site via his account and the heading “CONTACT “ or by post by writing to KATHELEY’S SPRL – Rue de la Chapelle, 131 – 4800 Verviers – Belgium, indicating surname, first name and e-mail address. The Member may access information concerning him/her and proceed to make modifications deemed necessary using the “MEMBER” areas, directly accessible on the site. 

  1. APPLICABLE LAW – COMPETENT JURISDICTION

These General Terms and Conditions are subject to Belgian law. Any legal action with a Member acting in a professional capacity and arising from the occasion of his interpretation and/or his execution, is the domain of the commercial tribunal in Verviers. For any other legal action, the parties attribute excusive competence to the tribunals of the legal quarter in Verviers.
